Iron Crown Enterprises had the right to devise those names. They were "canonical" for the MERP game, though not for Tolkien research. The right is derived from the movie rights Tolkien sold during his lifetime. Saul Zaentz eventually acquired those rights and has been using them to license various merchandising deals based on THE LORD OF THE RINGS and THE HOBBIT. He cannot sell merchandising rights based on THE SILMARILLION, UNFINISHED TALES, or any of the other Tolkien books.
