All the merchandising is derived from the rights that J.R.R. Tolkien sold in the 1960s. The Tolkien Estate does not control the film rights or related merchandising rignts for THE HOBBIT and THE LORD OF THE RINGS. The point still stands, Tolkein was the only one who was looking for mass satisfaction. The only reason these movies and merchandice are being produced is because it has potential to 'reel in the money'.
